These Terms and Conditions (Terms) govern your use of the Custom Comfort Medtek website, located at www.customcomfort.com (the Site), and any purchase you make from Custom Comfort Medtek, LLC (Custom Comfort Medtek or the Company).
By accessing or using the Site, or by placing an order for products, you agree to be bound by these Terms and all incorporated policies.
1. General Acceptance and Modification of Terms
1.1. Agreement: By accessing this Site and/or purchasing products from Custom Comfort Medtek, you affirm that you are of legal age to enter into this agreement or have the necessary parental or guardian consent.
1.2. Amendments: Custom Comfort Medtek reserves the right to modify or replace these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Site or purchase of products following the posting of any changes constitutes acceptance of those changes.
2. Intellectual Property Rights
2.1. Ownership: All content on the Site, including text, graphics, logos, product images, digital downloads, data compilations, and the underlying software and product designs, is the property of Custom Comfort Medtek or its content suppliers and is protected by United States and international copyright and trademark laws.
2.2. Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Site for the sole purpose of viewing, purchasing, or inquiring about Custom Comfort Medtek products. This license does not include any resale or commercial use of the Site or its contents.
3. Product Information and Ordering
3.1. Product Accuracy: Custom Comfort Medtek makes every effort to display the colors, specifications, and descriptions of its products accurately. However, we do not warrant that product descriptions, colors (due to variations in displays), or other content are complete, reliable, current, or error-free.
3.2. Order Acceptance: All orders are subject to acceptance by Custom Comfort Medtek. Receipt of an order confirmation does not constitute our acceptance of an order. Custom Comfort Medtek reserves the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.
4. Payment and Billing (Terms of Sale)
4.1. Pricing: Prices for products are subject to change without notice. The price charged will be the price in effect at the time the order is accepted by Custom Comfort Medtek.
4.2. Payment Terms: All invoices are due 30 days from the order shipment date. Invoices not paid within thirty (30) days become past due and immediately payable.
4.3. Accepted Payment Methods: We accept Visa, MasterCard, and American Express. A credit card processing fee may apply to credit card payments.
5. Shipping and Delivery
5.1. Lead Time: Due to the custom manufacturing and assembly of each order, please allow 4 to 6 weeks for delivery. This is an estimate and not a guarantee.
5.2. Rush Orders: Orders requiring a RUSH delivery must be coordinated with and approved by the Company’s Customer Service Department, and may incur additional charges.
5.3. Risk of Loss: Title to goods and risk of loss passes to the buyer upon shipment from Custom Comfort Medtek’s facility. Claims for damage occurring during transit must be made against the carrier.

6. Warranty and Limitations
6.1. Product Warranty: Custom Comfort Medtek warrants its manufactured products to be free of defects in material and workmanship for the specified periods (up to five years for most components, with specific periods for recliners, tables, vinyl, etc.). The full duration and terms are detailed in the official Warranty Policy document on the Site.
6.2. Warranty Exclusions: The warranty is available only to the original retail purchaser and is non-transferable. It does not apply when damage or repair is caused by:
- Damage in transit.
- Accident, alteration, abuse, or misuse (e.g., exceeding weight capacities, use in mental health facilities).
- Fire, water damage, theft, war, riot, hostility, or acts of God.
6.3. Exclusive Remedy: The purchaser’s exclusive remedy for defective products shall be limited to the repair or replacement of defective components, at the Company’s sole discretion. Custom Comfort Medtek shall not be liable for any labor, shipping, or other costs incurred in conjunction with a warranty claim.
7. Returns and Exchanges
7.1. Upholstered Items: Due to the inherent biohazardous risk associated with blood collection and medical settings, upholstered furniture cannot be returned after it has been removed from its original packaging.
7.2. Non-Upholstered Items: For non-upholstered items, a 30 percent restocking fee will apply to any approved return.
7.3. Defective Items: If a non-upholstered item is defective in any way, the defective part will be replaced or repaired free of charge.
8. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS SOLD ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CUSTOM COMFORT MEDTEK MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.
9. Limitation of Liability
IN NO EVENT SHALL CUSTOM COMFORT MEDTEK OR ITS AFFILIATES, OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCTS OR MATERIALS ON THE SITE, EVEN IF CUSTOM COMFORT MEDTEK OR A CUSTOM COMFORT MEDTEK AUTHORIZED REPRESENTATIVE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE. LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES IS EXCLUDED TO THE EXTENT PERMITTED BY LAW.
10. Privacy Policy

11. Governing Law
These Terms and your use of the Site shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the federal and state courts located in Orange County, Florida, to resolve any dispute arising out of these Terms or your use of the Site.
